Immunity Law SB133 By Senator Smitherman ENROLLED, An Act, Relating to mediation; to provide that a
mediator may not be compelled to testify or to produce documents concerning
mediation proceedings. BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: Section 1. For the purposes of this act, the
following words shall have the following meanings: (1) MEDIATION. A process in which a mediator
acts to encourage and facilitate the resolution of a dispute without imposing
a settlement. (2) MEDIATOR. A neutral third party
conducting a mediation, including any co-mediators, employees, agents, or
independent contractors of the mediator or co-mediator, and any person
attending or observing the mediation for purposes of training. Section 2. The Legislature finds that it is
desirable to encourage public confidence in the use of alternative methods of
dispute resolution by preventing a mediator from being compelled to testify
or produce documents about a mediation. Section 3. Except as otherwise permitted by
the Alabama Civil Court Mediation Rules, a mediator may not be compelled in
any adversary proceeding or judicial forum, including, but not limited to, a
hearing on sanctions brought by one party against another party, to divulge
the contents of documents received, viewed, or drafted during mediation or
the fact that the documents exist, nor may the mediator be otherwise
compelled to testify in regard to statements made, actions taken, or
positions stated by a party during the mediation. Section 4. This act shall become effective
immediately following its passage and approval by the Governor, or its

caravan - Turn right out of the Grand Hotel onto Scenic Highway 98. At one
mile, you will see the Wash House on the right. At 2 miles you will cross
Bailey's Creek. At 4.6 miles you will bear left, staying on highway 98 (don't
go straight on Co. Rd. 1). Stay on 98 through the 4-way stop, go over the
Fish River bridge, and turn right onto Gavin Lane, which is the first paved
road past the bridge (.3 mile past bridge). This is a total of 10.4 miles

Our Membership Membership in the Academy is by invitation only. We seek as members those attorney mediators who exemplify the greatest competence and the highest integrity, who not only perform excellent service for their clients but also enhance the profession of mediation. Our hope is that each member of the Academy will contribute skills and insights that will make the Academy stronger, make its members more proficient, and in the process make our state a more livable place.
